Who is eligible for a T Visa?

Individuals who are victims of severe forms of human trafficking, are physically present in the U.S. due to trafficking, and who cooperate with reasonable requests from law enforcement (unless under age 18 or unable to do so due to trauma).

How long does a T Visa last?

T Visa status is valid for up to 4 years and may be extended under certain circumstances.

Can T Visa holders apply for a Green Card?

Yes. After maintaining T Visa status for 3 years (or upon completion of a trafficking investigation), T Visa holders may be eligible to apply for permanent residence (a Green Card).

Can family members be included?

Yes. Eligible family members—such as spouses, children, parents (if the applicant is under 21), and unmarried siblings under 18—may be included in the application.

Do I need to work with law enforcement to qualify?

Generally, yes. Applicants must comply with reasonable law enforcement requests related to the investigation or prosecution of trafficking. Exceptions apply for minors and those unable to cooperate due to trauma.

Is there a limit on T Visas each year?

Yes. USCIS issues up to 5,000 T Visas per year for principal applicants. Family members do not count toward this cap.
