Who is eligible for a U Visa?

Victims of qualifying crimes (such as domestic violence, sexual assault, trafficking, stalking, or other serious offenses) who suffered abuse and are helpful to law enforcement.

How long does it take to get a U Visa?

Processing can take several years due to high demand, but deferred action and work authorization may be available while waiting.

Can family members apply with me?

Yes. Spouses, children, parents (if the victim is under 21), and some siblings may qualify as derivative applicants.

Does cooperation with police mean I have to testify in court?

Not always. “Helpful” means you have provided information or assistance to law enforcement, but each case is unique.

Can a U Visa lead to a Green Card?

Yes. After holding U Visa status for 3 years, you may apply for a green card (lawful permanent residence).

Will my abuser or perpetrator find out about my application?

No. U Visa applications are strictly confidential and USCIS does not notify the perpetrator.
